Nintendo Wins Piracy Battle

Nintendo's battle against Hong Kong-based manufacturer Bung Enterprises Ltd. was apparently victorious Thursday when a US Federal Court awarded Nintendo more than US$7 million in damages plus interest.

Bung, which creates products such as the Game Doctor series, allows the copying of Nintendo's game products from the cartridge to the computer where it can be distributed illegally. An injunction has been issued that prevents Bung from selling these products in North, Central, and South America.

Apparently Bung was not very cooperative during the discovery process, which did not help its case.

"Throughout the litigation Bung demonstrated nothing but contempt for the American judicial system and continued to develop and market products that were designed to permit the pirating of video game software of Nintendo and its third-party publishers," said Richard Flamm, Nintendo's General Counsel. "We are very pleased the court has resoundingly condemned Bung's conduct and confirmed the infringing nature of Bung's products."
