Lik-Sang versus Sony: Round 2

Sony hauls Hong Kong retailer back into court over PSP imports; UK High Court rules importing handhelds into Europe is illegal.

Lik-Sang, an online import game retailer based in Hong Kong, is in hot water with Sony once again, this time over the importing of Japanese PlayStation Portable consoles into Europe.

The two clashed back in 2003 when Sony settled a lawsuit against Lik-Sang over its sale of mod chips and modded PlayStation consoles. As part of the settlement, Lik Sang agreed to cease trading such goods.

Now Sony has scored another legal victory against the company, as Financial Times is reporting that Lik-Sang's sale of PlayStation Portable systems, software, and accessories into Europe has been unlawful. High Court Judge Michael Fysh ruled that various intellectual property rights that belong to the company had been infringed upon by Lik-Sang (also trading as Pacific Game Technology).

Lik-Sang responded to the ruling by issuing the following statement: "Fighting multiple lawsuits in different countries at the same time and paying high premiums to expensive lawyers is an overwhelming situation for a small company like Lik-Sang. Launching separate court actions with separate claims and different judges is completely unnecessary, except for the fact that it helps reaching one single target: outspend Lik-Sang to death."

The Lik-Sang release also poured cold water on Sony's claim that the Japanese company is suffering "losses and damages" as a result, and it claimed that Sony was intending to seek an injunction to stop its sales to Europe. The company added it was unsure how the ruling would affect its business operations with the upcoming PlayStation 3 and other PlayStation-branded items.

meimnobody, I think I understand what you mean now. The main point isn`t that Sony is envious because Lik-Sang is making profit by selling the psp at a cheaper price in the US and EU when they could be making that profit, it`s that they further lose money if this continues. I think what you are trying to say is that even if Sony would reduce the price in US and EU, the impact on sales will be very insignificant, so it`s pointless to reduce the price. That`s why Sony is complaining if somebody imports the psp, because they won`t buy the psp at the much-higher price that it`s in their country, inducing further loss to Sony. I guess I could partly agree to that. I don`t know Sony`s current situation, but I believe that Sony isn`t at a loss, it just wants more money. To me, the price for the psp seems just about right in Japan. In any case, thanks for sharing your opinion. Btw, is there an option to track the user comments on an article besides manually checking every hour?

Cloud sony doesn't make a profit on psp hardware sales. Sony sells their hardware at a major loss. Since EU and America buy the psp and software more then the Japanese do in the same time period Sony doesn't see the need to reduce the price since to them. Both the US and EU till the release of the ds lite sold as much units as the DS on a monthly basis. Till the lite that is being the operative. In Japan things were quite different with December 2005 selling over a million DSs while the psp sold about 150,000 units.

Sony whines again. Plain and simple. Now if Lik-Sang were keeping all the money from the Sony products and not reporting each and every sale so that Sony's numbers at the end of the fiscal year were affected, then I could see reason for Sony to complain. Consumers are going to find a way to play the games they want to play one way or another Sony. Would you prefer they mod-chip their systems or download ROMs from the net? Or would you rather people buy your product(s) and it all works in your favour? Suck it up or risk losing to Microsoft and Nintendo who'll only see their sales figures go up.

I don`t understand one thing: if Sony is envious at Lik-Sang because it makes a lot of money by exporting the japan version of the PSP (which is cheaper then the US or EU version), then why doesn`t Sony cut the price for the US and EU version of the PSP rather than sue Lik-Sang. That way, Sony could get a lot more cash than sueing Lik-Sang. But I gues that`s $$$ony for ya. They`re to blind and arogrant to see that they`re shooting themselves in the foot.

I'm not interested in the PS3 but I was curious about this news and look at the reaction of people who post comments here. U know what I think, the reason Sony sued one of those importers bcoz they keep hording the supply of PS3 that r being sold to japanese customers bcoz they want the PS3 to be successful in Japan. "VIVA LA Wii !!!"

Also Lik-Sang and other retailers will not be allowed to sell Japanese PS3s outside of Japan. Reasons gimped PS3 is cheaper in Japan and has more features then the other regional 20 gig PS3s. Since it is cheaper Sony losses a fortune and they don't want those PS3s outside of Japan. PS3 games in cheaper will also be cheaper then other regions. The only reason Sony has giving the Japanese more is because their own surverys said the PS3 would go up in flames if they didn't offer a cheaper better model. The game prices are also an incentive. Nintendo doesn't need to reduce the price because surverys have said Nintendo will have a huge hit with the wii. Sony is scared the PS3 will fail.

It should be noted that xbox 360 is region free but many of the games are not. This looks also apply to the PS3 since Sony hasn't stated if publishers cannot introduce a region coding. The blu-ray movies are region coded so any PS3 game could be region coded. Also certain countries do not allow region free consoles to be sold at retail shops. Certain regional divisions do hate importing because due to the countrys tax system games have like a 100% tax on them while imported games don't. Which is why certain countries have their customs agencies look for imported games and then confiscate them. Japan does have import restrictions a lot of animes are not allowed to be imported into Japan from say the US since the imported anime would be cheaper then the local version that came out years earlier.

Great job, Meimnobody! In this sea of incensed "sony is the devil" ranting, you've realized the real goals of these lawsuits, all the while keeping away from the partisanship that infests these boards like a virus. And Junji, while I can't speak for the UK, US copyright law does state that the copyright holder has the right to control in what region his/her work is sold. Most game companies just don't do anything because what's sold on the import market, by and large, are games that just don't have a shot in hell in the US market.

Here this is why Sony is suing lik-sang and other import shops. It's because the import shops are making lots of money by in Sony's eyes ripping off Sony. The Japanese psp price is far less then what other people in other terrorities pay. The Japanese psp often retails for less then a DS lite or just a few dollars more. The DS lite in Japan is about a 180 bucks whereas in the states it's about 140 bucks. Retailers in japan pay less for psp units then retailers in other countries. Retailers in Japan often have to bundle the psp with five games or umd movies to push twenty thousand units a week. If the psp hadn't dropped in price or them doing those bundles they would be pushing just a few thousand units a week. PSP games are often drastically cut in price. Loco Roco within two weeks was reduced to budget price. Most psp games follow that pattern of price cutting. It's unheard for other game systems to have so many titles cut in price in such a short time period. So retailers pay less for psp games to be on their shelves. No Japanese store that charges Japanese prices for psp games or units ships the units outside of Japan. Lik-Sang however does but they don't charge the Japanese prices but they paid Japanese retailer prices so Lik-Sang pockets a lot more money then retailers selling the Japanese customer prices or US or Europe customer prices. Retailer margins are very small for gaming hardware. An xbox 360 may only make a retailer selling the unit two dollars in profit. So Lik-Sang by buying the units at Japanese retailer prices and selling at the outside of Japan prices is making a huge profit margin say fifty or sixty bucks. Since Sony isn't seeing that money they aren't happy. This drastic difference in profit margin also applies to the psp games sold by Lik-Sang.

Even if it seems as if Sony was being a bit cruel to that small company ( i visit the site sometimes), they pretty much had every right to sue them.. They knew they should have watched their back when they got sued the first time so i guess maybe Sony is at big angry at them now.

LISTEN GUYS this article is incomplete !!! Yes it clearly bashes sony for "preying" on a small company that seems to be in legitemate business but it does not explain why sony has those measures in efffect!! i mean seroiously it is passed the psp launch date and all regions have their psp's which are relatively similar if not identical in function. so why sony should have these measures is puzzling !! and it would not be wise to just do exactly what the article wants:which is to bash sony untill we know the whole deal.!!!!!! I've used lik-sang myself, and can say that they're a great company to get import stuff. I would prefer not to import games and consoles from abroad, but some items are just not available here (UK). Anyway, does it really matter which country their products are sold in (sony's), as long as they're selling products. It's all about screwing us europeans over with inflated prices, that's why sony's doing it. That's why they put region lock's on games, it's so that they can control what we buy and at what price. Unfortunately it's not just sony that does it, but also nintendo and microsoft. They didn't all get to where they are right now by being nice to the consumer, but by trying to eliminate the opposition, starting with the smaller companies like lik-sang, so i can't see their attitudes changing anytime soon.

Sony needs to grow up. Lik-Sang is a great company bringing imports of games that Sony won't even localize. Some of the game companies are being two-faced. They won't bring over certain games because they dont' feel there is money to be made on them. But turn around and sue companies like Lik-Sang because the selling of those imports they weren't going to translate is "hurting business". BS, grow up Sony.
