EA facing yet another legal claim over Battlefield 4

Maryland law firm seeking shareholders for potential lawsuit.

[UPDATE] We've updated the wording of the first paragraph to more accurately reflect the situation.

Electronic Arts is facing yet another legal claim over its military shooter Battlefield 4. Maryland-based law firm Brower Piven this week announced it was in the process of seeking EA shareholders who could participate in a potential class-action lawsuit. The terms of the suit, announced in a press release this week, claim that senior EA executives knew--and did not disclose to the public or shareholders--that Battlefield 4 would be buggy at release.

The suit also claims that as a result of these issues--and the report that EA put all DICE projects on hold until the issues could be fixed--EA shares declined significantly, leading to widespread shareholder losses. EA has since clarified that the work being done to fix Battlefield 4's issue has not impacted the release of any future DICE projects, including the new Mirror's Edge and Star Wars: Battlefront games.

These are the same reasons behind the prior two legal claims against EA over Battlefield 4. It has also been revealed that various EA senior executives sold thousands of shares in the weeks leading up to Battlefield 4's release, though it's not clear if this is atypical.

Addressing the original class-action suit claim, from the legal team behind the Enron lawsuit, EA said, "We believe these claims are meritless. We intend to aggressively defend ourselves, and we’re confident the court will dismiss the complaint in due course."

We reached out to the same EA corporate communications representative for comment on this new report, but he declined. We will continue to monitor the matter as it progresses.

There are several components of this case that are important to remember and to consider. First, this suit does not pertain to consumers, but rather those who purchased EA common stock during the Class Period of July 24-December.

In addition, no suit has actually been filed yet against EA. Class-action lawsuits need a lead plaintiff to move forward within 60 days of commencement, and so far, no person has filled that role--that is a person who claims to have been financially harmed by Battlefield 4's issues.

In addition to heat from legal firms, a Chinese media report recently accused Battlefield 4 of discrediting China's image.

Remind me again how Battlefield 4 got 8/10 if it was such a glitchy bug-ridden mess at launch?

I recall the day that EA said BF would not be annual-based because they wanna deliver a better game...ha ha ha

EA are publishing Titanfall aren't they? I hope there isn't a single issue with that game because it looks like a modern art masterpiece.

You know, I had been enjoying Battlefield 4 immensely, even playing more than I normally would online before finishing the campaign which I started first.  Today I discovered that my campaign game save has disappeared all by itself.  Just gone and that's after the latest patch. WTF, over?

Eddie, I really think you are wrong on this article.

There's a plaintiff in the official document, right? Check it out:

"Plaintiff, Ryan Kelly ("plaintiff")", individually and on behalf of all others similarly situated..."

Are you really sure, dude?

My neighbour plays Battlefield and he's an utter fucking bellend. I can constantly hear him shouting abuse at people over his headset. In-game, I mute people like him. Unfortunately there's no mute button for people in real life. I wish he'd fuck off.

Haven't brought a COD game since MW3. It's utter shite unrealistic and populated by kids not old enough to play it, which is why I like BF, the complexity is enough to keep silly little kids out. That said I'm still playing BF3 and BF1943. Basically I noticed how poor and lacking BF4 was when I played the demo, my 17 yr old son loved it but to me it felt rushed and un finished which a month before release it shouldn't! Now I'm seeing copies of BF4 being sold preowned for the same price as BF3 which really doesn't inspire much confidence. Two promising games I was specifically waiting for have turned out to be utter shite this year, GTA V (online is poor and missing half the hyped up features I brought it for. Single player is as good, though shorter, as any other GTA. It's the online that's lacking). So when I've finished ACIV I might do what I swore I wouldn't and buy a COD just so I have online shooting action.

Matt Leblanc should sue EA because the guy in the picture linking to this page looks like him.

Everyone bitching about EA are a bunch of cry babies.

If you don't like EA, don't buy it.

Personally, I'm sick of hearing all this bullshit.

So funny, I guess console must of had it really bad because Including the beta I have over 100 hours into bf4 and never once was I not able to play smoothly. I had the occasional server disconnect usually at the end of a round but that happens.  I don't know what all the fuss is about, and most people online are higher ranks than me. Not to mention my favorite servers are always  full.

Bottom line is bf cannot compete with cod so they need to stop trying. Just make your game and release it when it's ready

I hope it makes it to court and I hope the obviousness of this is brought to light.

Example, which is clearly visible to all. A stable, earlier build of BF4 was put out at Beta, with EA and DICE knowing what they had to release only 2 weeks ahead; a bug-filled unstable mess, but it didn't matter, so long as the pre-orders rolled in.

DICE PRs (and Patrick Bach) himself falsely told media that this was the most complete, well rounded Battlefield to date. That is obviously far from the truth.

All the while folks like EA CEO Andrew Wilson scored huge profits from share investment in the business, along with a few other EA higher ups.

Conspiracy? No. If anyone thinks so then they are incredibly naive. Money makes folks greedy, if they have it, they want more.

Putting an early BF4 build out for the so-called beta and then releasing the actual, unstable, bug filled messed (with different water shaders etc), to the public after over hyping the game and saying it was perfect and the best BF yet, was evidently there for the sole purpose of scoring money. Not to please gamers, but to score money. Why else would they rush it out? If this was any other industry, it'd be illegal, so I do hope that misleading hundreds of thousands of people with false claims for the sake of cash, results in them having a heavy penalty, or at least being instructed to dish out refunds of some kind. I payed £94.98, I know BF4 Premium doesn't really count but of course it runs within the Frostbug Engine, so that too ends up being a waste.

There's even a video out there of a DICE employee saying they hate it when their games have to be released because they're never finished. This was during a streamed event prior to BF4 launch. I'd wager the folks gaming on those machines were also playing an earlier, stable build.

The game is playable, an even though my crashes have dropped significantly, I still can't play Siege of Shanghai and I have a list of over 190 things (real things, not complaints about balance), that show truly how screwed up the game is.

If you want to see said list, I'll post it, but I don't think it'll fit here.

I figured I'd give EA a chance, in the hope that BF4 would expand on BF3, but it feels completely different. The bugs, the balance, the map design, all of it sucks. China Rising, consists of nothing but land mass, a few bare capture points and a centre point with (usually the most buildings) and a bomber that distracts from objectives.

Guillean Peaks is probably the only decently designed map, alongside Silk Road.

Finally, patching... wow, what a poor effort. According to a Swedish website, fiz something, a DICE guy commented saying it's very difficult for them to find what is going on. This'll explain the placebo patches. They were exactly that.

The last few patches have also been a huge disappointment for me and many others who have few, or no crashes at all. We have to wait months on end (and probably longer) for things that have been in the game since BF4 beta. Example, not able to look out of Vehicle windows with RMB unless you cycle view (unable to bypass bug in hardcore). HMG blocking tank view (cannot bypass bug in hardcore or servers with no 3rd person vehicle view). And the big one... Voice Overs not being spoken in the language reflected in settings - this was a bug in BFBC2, carried over to BF4 in a rush to get the game out, an ultimately overlooked because of the same reason.

Gustav Halling favourited my tweet and probably watched my evidence video after he asked me for a link showing him the V.O bug, where Russians and Chinese will speak Russian and Chinese instead of the selected English. He didn't even know of it until I pointed it out. How marvellous.

Every patch, is a "tweaked" or "crash" that, but being catapulted in the air whilst vaulting over something, getting stuck on invisible things, not being able to look out of your windows, an 1 shot kills still rampant (yes they are still there, just not often) is less important for them.

Those of us who get few or no crashes will have to wait months for other minor fixes, especially since it takes 2-4 weeks a pop for DICE to release a patch that does the same thing it was supposed to do last patch, along with a pathetic 3-4 other fixes.

I love the game... well I want to love it, an I'm not complaining for the sake of it. It's just the quality (or lack of) is beyond a joke.

Oh and err... if you read this wall of truth and didn't like it...

*ahem*.... LOLLLLLLL!

But seriously EA, DICE... "Fix YOW GAME!"

Do people not realize that DICE can not get away from EA. I see lots of people say i wish DICE would stop letting EA publish their games ETC. Well the sad news is that DICE is now EADICE, they are owned by EA and forever forced to use EA as a publisher.

@mikees1 I'm not going comment on COD being filled with kids that shouldn't be playing it, cuz I agree.. but the game being unrealistic? It's an arcade shooter, it's not supposed to be realistic.

@DrKill09 To some extend I agree, however this BF4 release goes beyond people crying.  I think its pretty clear that Dice was thrown under the bus on this one and was forced to put out a broken product because of the next gen releases.  EA just couldnt miss out on the cash cow... they thought... ahhh, we'll just fix it.  Nope.  BF4 is so broken and so buggy its going to be months before its in a state that it should have been in the first place.

If you compare EA to Ubisoft, you can clearly see a difference in production quality.  I am hoping EA gets its hand burned on this one, even if it means the end of the BF franchise.

@b74kd3th They cant... EA is totally obsessed of competing against Activision. EA will sacrifice themselve to take down Activision if they have to and they did with BF4... and guess what... the line will not stop there EA will continue.

Just wait and see, when Activision announce their COD... EA will follow...

@UKFX You sat there and made a list of 190 things you don't like about the game? Come on, other than a couple of crashes I've really enjoyed BF4 and the sounds glitch is nothing more than annoying. I hope they do finally patch these problems out.

UKFX

@N12K@UKFXActually no. There was already an existing list that had over 250+ bugs/issues on it, but I went through it after an evening of enduring said bugs on BF4. I took out the balance oriented complaints and added a few bugs I've experienced or seen.

http://battlelog.battlefield.com/bf4/forum/threadview/2955064770579715724/1/

Naturally, with the volume of complaints and the fact EA doesn't sticky useful constructive topics on the Battlelog forums, the thread was buried within a short time.

@Stebsis and by the third, or fourth sequel there will be quick time events.

Stebsis
Stebsis

@Kangkoopa713On the plus side Titanfall is a new IP, EA always seems to do well with those, be they publishing or developing, like Mass Effect, Dead Space etc. but then they usually just get worse and worse because they've already gotten the fanbase that'll buy the sequels no matter what
