Combat Elite on track, lawsuit or not

Acclaim affirms its WWII title is theirs, and on schedule for a June release.

On Monday, game publisher Interplay filed suit in Los Angeles against game developer BattleBorne, claiming that the developer improperly terminated an agreement to produce the game Airborne (now known as Combat Elite: WWII Paratroopers, and now being published by Acclaim). Interplay says the developers refused to return a $250,000 advance tendered to BattleBorne to develop the game. The suit alleges breach of contract, among other claims, and seeks the $250,000 advance--and interest. When contacted, an Acclaim spokesperson asserted that "Combat Elite is very much the company's property." The game maintains its June release date.
