Bungie seeking to trademark Glimmer, Hive

Destiny developer also files applications for Vex, Fallen, and Cabal to cover use for games, Halloween clothing, books, and more.

Destiny developer Bungie has filed five different trademark applications with the United States Patent & Trademark Office (USPTO) for Glimmer, Fallen, Hive, Cabal, and Vex potentially related to the company's all-new "shared-world shooter" to be published by Activision.

The trademark applications, each filed March 11, cover a variety of uses. If the USPTO grants Bungie the trademarks, the developer will be able to use them to create and sell interactive game software, graphic novels, Halloween costumes, TV programs, ringtones, and footwear, among a long list of other items based on the names.

Cabal and Vex are the names of enemies in Destiny, and Fallen has previously been used in the game's marketing material. Glimmer and Hive have not been spoken of before with regards to Destiny.

A Bungie representative was not immediately available to comment.

Destiny is currently officially in development for Xbox 360, PlayStation 3, and PlayStation 4, though Bungie's own preorder page suggests the game is also coming to Wii U, PC, PlayStation Vita, and the Xbox 720.

...Exactly how would that work? Is it only related to video games? Would they be able to sue a commercial with " I've FALLEN and I can't get up?" Would people no longer be able to claim they have bee hives? A hive is a zerg structure in starcraft. This seems weird to me, don't copyright basic words.

Oh, and the main villains in Blood were the Cabal. And Vex was in Skyrim. And Hive has been in just about any game with insect enemies or characters ever. Yeah Bungie are fucking morons.

@dpadam450 Yeah, not to mention the Transformers movie with Fallen in it.  Does this mean if they decide to publish a game based off that movie, they can't do it because of this patent?  So stupid.  This is getting out of hand like everything else in the world.

Given that it will be 'Published' by Activision you can expect a large amount of DLC / Microtransitions and various other 'Milking' mechanisms, hell i would'nt be suprised if this was actually turned into a 'Subscription' based game.

@Kr3isen It's worth noting the irony of your statement here, considering Star Wars started a tremendous merchandising push on every front before the first film was even out and back when no one had a single idea what it was (in fact most were expecting it to fail).

@Roger_Smith Bungie has full control over Destiny. Activision is only publishing it. Bungie is independent and I'm sure that's how they'll keep themselves.

@RedLegZeff It's pretty much only related to video games.  The court looks at "possibility of confusion" when it determines whether a trademark is infringed.  There is no possibility of confusion for something like "I've FALLEN and I can't get up" because no one would think that it was a Bungie brand.  On the other hand, it might apply to action figures and comic books because it's conceivable that the trademark might be expanded to those markets.

@thenephariouson I say the same thing I said to Roger_Smith: Bungie has full control over Destiny. Activision is only a publisher. They can't go to Bungie's office and say "Not like that, like this."It is a violation of the contract.
